Qualification - Council

A candidate for a municipal office must, upon nomination, be a qualified municipal elector and fulfill all of the following requirements:
- a resident of the municipality, a non-resident owner or tenant of land in the municipality or the spouse of such non-resident owner or tenant;
- a Canadian citizen;
- at least 18 years old;
- not legally prohibited from voting; and
- not disqualified by any legislation from holding municipal office.
A candidate, if nominated, must remain qualified throughout the election and, if elected, throughout the term of office.
An employee of a municipality who wishes to run for office in the municipality that is their employer must take an unpaid leave of absence prior to being nominated. If elected, the employee must resign his or her employment with the municipality.
If an employee of an upper tier or lower tier municipality wishes to run for office of the opposite tier, they can run without taking an unpaid leave of absence or resigning provided that being elected to the opposite tier does not include sitting on the other tier.
Persons Not Eligible to Run for Council

The following persons are disqualified from being elected to municipal office:
- any person not eligible to vote in the municipality;
- an employee of a municipality unless her or she
- Takes an unpaid leave of absence before being nominated, and
- Resigns, if elected to the office;
- a judge of any court;
- a member of the Legislative Assembly of Ontario, a Senator or a member of the House of Commons; or
- an inmate of a penal or correctional institution under sentence of imprisonment.
Qualification - School Board

A candidate for a school board must, upon nomination, be a qualified municipal elector and fulfil all of the following requirements:
- a resident within the jurisdiction of the board;
- a supporter of the board;
- a Canadian citizen;
- at least 18 years old;
- Roman Catholic (if running for a separate school board);
- not legally prohibited from voting; and
- not disqualified by any legislation from holding school board office.
A candidate, if nominated, must remain qualified throughout the election and, if elected, throughout the term of office. School board candidates should confirm that they have the qualifications described in section 219 of the Education Act.
An employee of a school board who wishes to run for office on any school board must take an unpaid leave of absence prior to being nominated. If elected, the employee must resign. A person may not be employed by one school board and hold office on a different school board.

A candidate for school board office cannot be a clerk, deputy clerk, treasurer or deputy treasurer of a municipality within the jurisdiction of a board.

Nomination Procedures

Nominations for candidates may be filed with the Clerk or designate at the Administration Centre, 2231 Nursery Road, Minesing (in Midhurst), commencing January 4, 2010 during regular business hours (Monday to Friday 8:30 a.m. - 4:30 p.m.) up to and including 2:00 p.m. on Nomination Day (Friday, September 10, 2010).
Candidates must file the prescribed Nomination Form, accompanied by the prescribed filing fee of $200.00 for Head of Council (Mayor) or $100.00 for all other offices made payable to the Township of Springwater by cash, certified cheque or money order. Faxed nominations will not be accepted, as an original signature is required on all election documents filed with the Town
Candidates are required to show proof of identity and qualifying address at the time the nomination paper is filed in person by the candidate or agent. Each person who files a Nomination Paper will also be required to complete a "Declaration of Qualification - Council" or "Declaration of Qualification - School Trustee".
Upon filing you will also be asked to sign a Personal Information Release Form which will allow us to post your personal information on the website and on any municipally generated election information documents.
Municipal By-law 2009-072 regulates Municipal and School Board Election Signs within the Township of Springwater. Each candidate is required to submit a deposit fee in the amount of $100.00 prior to erecting any election signs. Sign deposits are due and payable at the time of the filing of nomination papers and prior to the erection of any signs for any municipal or school board candidates.
No person who proposes to be a candidate may solicit or accept contributions for election purposes, or incur expenses, until that person has filed a Nomination Form.
Prior to 4:00 p.m on Monday, September 13, 2010, the Clerk shall examine each nomination filed and if satisfied the person is qualified to be nominated and that the nomination complies with the Act, the Clerk will certify the Nomination Paper. If not satisfied, the clerk will reject the nomination and as soon a possible give notice to the person who sought to be nominated and to all other candidates. The Clerk's decision to certify or reject a Nomination Paper is final. It is the responsibility of each candidate to ensure they are qualified to run for the office for which the nomination is filed.
The campaign period begins January 4, 2010 or whenever a candidate files a nomination paper, whichever is later, and ends on December 31, 2010 unless the candidate withdraws the nomination, the Clerk rejects the nomination or the candidate is continuing his or her campaign to erase a deficit (subject to filing the appropriate documentation).
Election Contributions and Expenses

The Municipal Elections Act, 1996 imposes limitations on the expenses for candidates in municipal elections and also imposes requirements on the candidate to report the contributions received and the funds expended.
Further, under the Municipal Elections Act, a contribution shall not be made or accepted by or on behalf of a person unless he or she is a candidate. Contributions may only be made during an election campaign period.
The new spending limits for the head of Council are $7,500 plus 85 cents per elector and for the remaining offices $5,000 plus 85 cents per elector.
Withdrawal of Candidacy

If a candidate decides to withdraw from the election, he or she must notify the clerk in writing no later than 2:00 p.m. on Nomination Day (Friday, September 10, 2010) by filing a withdrawal of nomination form.
A candidate who withdraws before nomination day is entitled to a refund of the nomination filing fee. A candidate who withdraws is still required to submit a completed financial disclosure covering all financial transactions made up to the date the nomination was withdrawn.
