      The Township, along with its consultant K. Smart and Associates, has completed its project under section 78 of the Drainage Act to improve and extend the outlet of the Swaley Drain.

      The Swaley Drain is a municipal drain that was originally built in 1898 and incorporates a watershed area that reaches from the southern edge of Anten Mills, parts of Minesing and several rural properties in between. Of the three municipal drains in the Township that outlet to or through the Minesing wetlands, the Swaley Drain is the only one that does not have an adequate and legal outlet.

       Project Background

      At the Council Meeting on December 7, 2016, Council accepted a Notice of Drain Improvement from an affected land owner to improve the outlet of the Swaley Drain. This work was requested to alleviate current drainage issues as field tile outlets are malfunctioning due to high and rising water levels within the drain.

      In 2017, Kenn Smart of K. Smart and Associates was appointed to complete a Scoping Study involving affiliated and affected parties of the Swaley Drain. Mr. Smart was then appointed to prepare a Preliminary Report on the outlet of the Swaley Drain under Section 78 of the Drainage Act.

      In 2021, Council authorized a Final Report by Mr. Smart and provisionally passed Swaley Drain By-Law 2021-091 to approve the Final Report. As per Section 46 of the Drainage Act, a Court of Revision was held on November 1, 2021 to hear landowner challenges to their assessments within the provisionally adopted Swaley Drain By-Law.

      Extension works commenced in January 2022 and concluded in February 2022. The total estimated project cost is $357,000.00.

      Hearing Notice - Court of Revision – Drainage Assessment Appeals – Swaley Drain

      Take notice that the Council of the Corporation of the Township of Springwater provisionally adopted By-law 2021-091 Being a By-law to Provide for Drainage Works in the Township of Springwater, in the County of Simcoe (Swaley Drain) on September 27, 2021.

      The Court of Revision will hold a hearing virtually via Zoom on Monday, November 1, 2021 at 6:30 pm to receive Notice of Appeals from landowners regarding the Swaley Drain Final Report - Drainage Assessment.

      Landowners may file a Notice of Appeal with the Court of Revision for the following reasons:

      • They feel an assessment against their/other land(s) is too low or too high;
      • They feel that land should have been assessed but has not;
      • They feel that due consideration has not been as to the type of use of the land.

      A Notice of Appeal may not be submitted regarding the technical aspects of the Final Report and will only be accepted for the above noted reasons.

      A Notice of Appeal shall be submitted on the prescribed form “Notice of Appeal to Court of Revision”. Written Notices of Appeal shall be submitted to the Clerk’s Office no later than Friday, October 22, 2021 at 4:30 pm via mail, in-person or via email.
