Fees and by-law
Development Charge By-law 2023-070, as amended by By-law 2024-061, By-law 2024-087, and By-law 2024-100, applies one-time development fees on new development or redevelopment so that the cost of providing new infrastructure is not borne fully by existing taxpayers. Rates are indexed annually on January 1. The By-laws also includes area specific development charge.
Development charge background study
The Development Charges Act requires that a background study be prepared to determine fees based on current service levels and the forecasted amount, type and location of future development within the municipality. Notice of Passing of a By-Law to Amend Municipal Wide Development Charges By-law No. 2023-070 |
Take notice that the Council of The Corporation of the Township of Springwater passed By-law No. 2024-061, being a by-law to amend municipal wide Development Charges By-law No. 2023-070 on the 3rd day of July, 2024 under section 2(1) of the Development Charges Act, 1997, S.O 1997 c. 27, as amended; And take notice that the More Homes Built Faster Act, 2022 (Bill 23) introduced the mandatory phase-in of development charge rates over five years for development charge by-laws passed on or after January 1, 2022. The Cutting Red Tape to Build More Homes Act, 2024 (Bill 185) received Royal Assent on June 6, 2024 and eliminates the five-year phase-in of development charge rates. The purpose of the amending by-law is to remove the development charge phase-in provisions in Development Charges By-law No. 2023-070 and implement the full calculated rates for July 4, 2024.
Take notice that the Council of The Corporation of the Township of Springwater passed By-law No. 2024-087, being a by-law to amend municipal wide Development Charges By-law No. 2023-070 on the 6th day of November, 2024 under section 2(1) of the Development Charges Act, 1997, S.O 1997 c. 27, as amended; And take notice that the More Homes Built Faster Act, 2022 (Bill 23) introduced the removal of growth-related studies as eligible capital costs. The Cutting Red Tape to Build More Homes Act, 2024 (Bill 185) received Royal Assent on June 6, 2024 and allows for growth-related studies as eligible capital costs. The purpose of the amending by-law is to add growth-related studies as eligible capital costs in the Township’s Development Charges By-law No. 2023-070.
Take notice that the Council of The Corporation of the Township of Springwater passed By-law No. 2024-100, being a by-law to amend municipal wide Development Charges By-law No. 2023-070 on the 4th day of December, 2024 under section 2(1) of the Development Charges Act, 1997, S.O 1997 c. 27, as amended; And take notice that the Cutting Red Tape to Build More Homes Act, 2024 (Bill 185) received Royal Assent on June 6, 2024 and reduces the requirement for municipalities to freeze development charges imposed on developments subject to site plan and/or a zoning by-law amendment. The purpose of the amending by-law is to reduce the development charges freeze period from 24 months to 18 months, and to update the capital cost estimate for Fire Station 2 in the Township’s Development Charges By-law No. 2023-070. And take notice that any person or organization may appeal to the Ontario Land Tribunal under section 14 of the Act, in respect of the development charges by-law, by filing with the Clerk of the Township of Springwater on or before the 14th day of January, 2025 a notice of appeal setting out the objection to the by-law and the reasons supporting the objection. |
